Parties to the Agreement
- Charterer: The individual or legal entity initiating the aircraft rental.
- Service Provider: A broker acting as a facilitator between the Charterer and certified aircraft operators (Carriers).
- Carrier: A licensed air operator legally responsible for operating the flight.
The Service Provider does not operate aircraft and acts only as an intermediary unless explicitly stated. Each party is responsible for their respective roles, ensuring legal compliance and coordination with aviation authorities.
Scope of Service
Charter service includes aircraft rental with crew, flight planning, ground handling, and standard in-flight amenities as outlined in the booking confirmation. Operations are limited to the agreed routes, schedule, and aircraft type. Services exclude visa processing, hotel accommodations, and personal travel insurance. Any modifications or special arrangements require prior approval and may be subject to additional charges.
Usage Conditions
The aircraft must be used exclusively for the purposes outlined in the booking, adhering to all aviation laws, safety regulations, and airport procedures. Unauthorized use, transport of prohibited items, or deviation from the agreed itinerary is strictly forbidden. Passengers must follow crew instructions at all times to ensure safety and compliance. Failure to meet these conditions may result in immediate termination of the charter without refund.
Payment Terms
To confirm your booking, full prepayment is required within the time specified on the document. Payment can be made by credit card or bank transfer, depending on the selected currency. Once the travel plan and quotation are finalized, a Proforma Invoice will be issued. This preliminary invoice outlines all costs clearly, including the base fare, service charges, and any anticipated fees. It will also include the payer’s name, billing address, and the preferred payment method.
Liability and Indemnification
The charter provider is responsible only for services directly under its control and is not liable for delays, cancellations, or losses caused by weather, air traffic restrictions, technical issues, or other factors beyond operational control. Passengers are responsible for any damage caused to the aircraft or equipment during the charter. By accepting the terms, the charterer agrees to indemnify and hold harmless the provider, crew, and affiliates against all claims, liabilities, or expenses arising from misuse, non-compliance, or third-party actions during the flight.
Aircraft and Crew
Aircraft and crew are assigned based on availability, suitability, and the confirmed itinerary. All aircraft meet safety and maintenance standards as required by international aviation authorities. Crew members are fully licensed and trained to deliver professional service and ensure passenger safety throughout the journey. Substitutions may occur if necessary due to operational or safety reasons, without compromising the quality or scope of the service.
Documentation and Compliance
All passengers must provide valid identification, visas, and travel documents as required by the departure, transit, and destination countries. It is the charterer's responsibility to ensure that all documentation is accurate and complete prior to departure. Failure to comply with immigration or customs regulations may result in denied boarding, delays, or penalties. The charter operator reserves the right to refuse service if documentation requirements are not met in full.
Final Provisions
These terms form the final and binding agreement between the charterer and service provider. Any amendments must be made in writing and approved by both parties. If any clause is found to be invalid or unenforceable, the remaining provisions shall remain in full effect. This agreement is governed by the applicable laws of the jurisdiction stated in the booking confirmation, without affecting the validity of the service provided.
