Charter Terms
1. Introduction
By confirming your booking, you agree to these Charter Terms, which define the rights and responsibilities between you (the Charterer) and the Service Provider (Operator or Broker).
2. Parties to the Agreement
- Charterer: Individual or organization requesting the service.
- Service Provider: Broker assisting in securing aircraft from licensed operators (Carriers).
- Carrier: Licensed air operator responsible for the flight.
The Service Provider acts solely as an intermediary unless specified otherwise.
3. Scope of Service
The service includes arranging a private aircraft as per your Charter Quote, covering basic operational costs like:
- Aircraft and crew
- Standard catering
- Fuel
- Basic landing and handling fees
Additional services may incur separate charges.
4. Usage Conditions
- Passenger Identification: Valid government-issued ID (domestic) or passport and visa (international) required before boarding.
- Conduct: Passengers must comply with customs, immigration, and safety regulations.
- Prohibited Items: No hazardous materials without prior written approval.
- Weight and Baggage: Pilot-in-Command makes final decisions on load limits and baggage.
5. Payment Terms
- Charter Price: Full payment required before flight confirmation.
- Included Costs: Aircraft, crew, fuel, catering, basic handling.
- Excluded Costs: Taxes, special catering, ground transport, Wi-Fi, crew overnight, parking, customs fees, de-icing, etc.
- Method of Payment: Bank transfer and credit card (fees may apply).
- Late Payment: May result in suspension or cancellation of service.
6. Liability and Indemnification
- Client Liability: Charterer is responsible for any damage caused by themselves or passengers.
- Indemnification: Charterer indemnifies Service Provider, Operator, and Carrier unless caused by gross negligence or misconduct.
- Operator Liability: Governed by applicable international conventions, with limited liability.
7. Aircraft and Crew
Aircraft and crew are subject to availability. Equivalent substitutions may be arranged if needed.
8. Documentation and Compliance
All required documents and approvals must be valid and available. Failure to comply may result in denied boarding.
9. Final Provisions
These Terms, together with the Charter Quote and any additional agreements, form the complete understanding between parties.
